1. What HunterPass is

HunterPass is software, operated by HunterPass, LLC, a Colorado limited liability company (“HunterPass,” “we,” “us,” “our”). It provides the tools by which landowners define access to their property, clubs manage their members and operations, outfitters and guides manage bookings, and verified hunters request and record access. HunterPass, LLC is the only party to these terms.

HunterPass is not a party to your hunting arrangement. The lease, the access agreement, the club membership, and the guided hunt are between you and the other party. We provide the platform on which those arrangements are recorded, gated, and settled.

2. Eligibility and verification

• Accounts are for adults who can form a binding contract.
• Hunters must complete identity, license, and hunter-education verification before requesting access. Providing false information in verification is grounds for immediate removal.
• Outfitters and guides must hold and maintain the registrations, bonds, insurance, and certifications their state requires. Assignment is blocked where those have lapsed.
• You are responsible for holding the correct licenses, tags, and stamps for the hunt you are booking. The platform records what you provided; it does not issue anything.

3. Access is granted by the landowner

No booking on HunterPass grants a right to be on any property. Access exists only when the landowner or their managing club has approved it, the required agreements are signed, and the booking is current. Access may be withdrawn at any time by the landowner or the club, for any reason or none.

Entering private land without current, approved access is trespass and is your responsibility alone.

4. Location data

Precise property information — coordinates, boundaries, parking, gate codes, and access notes — is confidential. It is released to you for a specific approved booking and may not be published, shared, republished, or used for any purpose other than that booking. Disclosing it is grounds for immediate and permanent removal.

5. Agreements and waivers

Access is gated on a signed waiver and any access agreement the property requires. Those documents are between you and the landowner, club, or outfitter, and they are versioned — the version you signed and the time you signed it form part of the record.

6. Payments

• Dues, access fees, deposits, and balances are collected through the platform via Stripe. Payouts to landowners, clubs, outfitters, and guides run through Stripe Connect.
• Platform fees are published at hunter-pass.com/pricing and are deducted from the relevant payout or passed through at checkout as stated there.
• Cancellation, refund, and forfeiture terms are set by the landowner, club, or outfitter for their own offering. HunterPass enforces the terms as written; it does not set them.
• Tax reporting obligations, including 1099 issuance where applicable, follow from the payout records.

7. Conduct

You agree not to:

• Misrepresent your identity, licensing, or standing.
• Publish or share confidential property location data.
• Access a property outside the dates, hours, areas, or terms approved.
• Hunt outside the season, method, unit, or bag limits set by the state.
• Circumvent the platform to avoid fees on an arrangement it introduced.
• Scrape, resell, or republish listings, records, or property data.

8. Safety and law

You are responsible for hunting safely and lawfully. Season dates, legal-take criteria, weapon restrictions, baiting rules, and carcass-transport requirements are set by your state wildlife agency and vary by unit and by year. Information on this platform is provided for convenience and is not a substitute for current regulations.

9. Content and records

Property information, club records, harvest records, and habitat records belong to the landowner or club that produced them. By submitting content you grant HunterPass the license needed to operate, display, and back up the platform — nothing more. We do not sell your data and we do not aggregate club or landowner records into a product.

10. Suspension and termination

We may suspend or terminate an account for breach of these terms, falsified verification, disclosure of location data, unsafe conduct on a property, or non-payment. You may close your account at any time; records with retention obligations survive closure.

11. Disclaimers

The platform is provided as-is. HunterPass does not warrant the condition of any property, the conduct of any hunter, club, outfitter, or landowner, the presence or availability of game, or the outcome of any hunt. Hunting involves inherent risks, including risks of serious injury and death, which you accept.

12. Limitation of liability

To the maximum extent permitted by law, neither HunterPass, LLC nor its parent, affiliates, members, managers, officers, employees, or agents is liable for indirect, incidental, or consequential damages, or for injury, property damage, or loss arising from conduct on any property or from any arrangement between users.

HunterPass, LLC’s parent and affiliated companies are not parties to these terms and provide no service under them. They are named here only as beneficiaries of the limitations in this section, and nothing in these terms makes them liable for any obligation of HunterPass, LLC.

13. Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law provisions. HunterPass, LLC is a Colorado limited liability company, and the state and federal courts sitting in Colorado have exclusive jurisdiction over any dispute arising from these terms or from use of the platform.

14. Changes

These terms will change before the first region opens, and again as the platform grows. Material changes will be notified to account holders, and continued use after notice constitutes acceptance.
